This is purely my opinion and I recommend that all First Time Home Buyers must take Independent Legal Advice to secure their rebate money and avoid any adverse situations. If you are a First Time Home buyer and buying new home from the builder, make sure that in APS, the rebate is not assigned to the builder. I have seen the APS of few builders which include clauses that might permit builder to assign all rebates, WHETHER BEFORE, AT TIME OF CLOSING OR AFTER CLOSING, to their benefit.
An APS also stated that if the buyer gets any funds for rebate after the closing, then the buyer must pay it back to the builder. Please check APS to avoid any bad surprise. (Thought written by Ajay Sharma, Real Estate Broker)
